Drafting starts with an invention disclosure session with the engineers, not with a form. The object of that session is to find the technical mechanism that produces the claimed advantage, because under current Federal Circuit law that mechanism is the only thing that makes the claim eligible. Where the advantage is a resource or efficiency gain, it goes into the claim language itself, which is what Ex parte Desjardins requires.

Office action responses, examiner interviews, continuation and divisional strategy, and appeals when the record is better than the examiner’s position. Eligibility rejections get the Director’s August 2025 memorandum cited on the record and the examiner held to the evidentiary burden it imposes.

The firm has kept a zero missed deadline record since 2016, on a docketing system built for that purpose.

Appeal briefs, reply briefs and oral argument. An appeal is a decision about the whole family, not one application, so it is taken with the continuation strategy and the client budget on the table at the same time.
